What are my legal right when an inconsiderate neighbor will not stop smoking by my window, in Santa Clara, CA?
In other words my Neighbors come outside to smoke, making me prisoner in my home, I can’t go out side because of the smoke or open my window because the smoke will come in, I have tried asking them to warn so that I may close my windows they Thought that was pretty funny HELP!
Speak to your landlord, asking him/her to act as a mediator so you can work something out; they could have a specific smoking area, or at the very least give you a warning.
Some counties have passed laws defining smoking as a "public nuisance," specifically regarding tenant disputes.
